The agreement between us, in plain words

These are the rules for using 24Host7. We wrote them to be read, not skimmed past. If anything is unclear, ask us.

1. About these terms

These terms are the agreement between you and DivyWeb LLC, an Arizona limited liability company doing business as 24Host7 ("24Host7," "we," "us"). "You" means the person or business that signs up for or uses our services. If you sign up for a business, you confirm you are allowed to agree to these terms on its behalf.

They cover our website, your account area, domain registration, website hosting, and anything else we provide (together, the "services"). Our privacy policy and refund policy are part of these terms.

You accept these terms when you check the box to agree at checkout or create an account. You must be at least 18 years old to buy our services.

2. Your plan and how it renews

You choose to pay monthly or yearly when you order. Your service renews automatically for the same length of time, at the same price, until you cancel. We charge the card on file on each renewal date.

If we ever change the price of your plan, we will email you at least 30 days before the new price applies, so you have time to cancel if you want to.

We send a renewal reminder by email before each yearly renewal.

3. Cancelling

You can cancel any time, online, the same way you signed up: from your account area, or by sending us a message. There is no phone call to make and no reason required.

When you cancel, your service stays on until the end of the period you already paid for, then it ends. Cancelling in your first 30 days of hosting gets you a refund under our refund policy. Before your service ends, download a copy of anything you want to keep. We delete hosting account data when the account closes.

4. Paying for your service

Prices are shown on our website and in your order. There is no setup fee. Invoices are due on the date shown, and we charge your card on file automatically. Sales tax or other taxes are added where the law requires them.

If a payment fails, we email you and try again. If an invoice is still unpaid 30 days after its due date, we may suspend your service until it is paid. If it stays unpaid for 30 more days, we may close the account and delete its data. We do not charge late fees or reconnection fees. Suspended service is turned back on during business hours, Monday through Friday, 9 a.m. to 6 p.m. Arizona time, once payment is received.

If you think a charge is wrong, tell us within 60 days of the invoice date and we will look into it. Unpaid balances may be referred to a collection agency.

Charges appear on your card statement as DIVYWEB LLC.

5. Domain names

We register domain names for you through an accredited domain registrar. The domain is registered in your name, and you are its owner. These rules also apply:

The rules for web addresses require your contact details to be accurate and kept up to date. If they are false, or you do not answer a required verification email, the domain can be suspended.
Domains renew automatically each year unless you turn renewal off. If a domain is not renewed, it can expire and may be lost to someone else. Recovering an expired domain can cost extra, and that cost comes from the registry, not from us.
You can move your domain to another company at any time. We will give you the transfer code when you ask. The registration rules block transfers for 60 days after a domain is registered or transferred.
Domain registrations, renewals, and transfers cannot be refunded.
The registrar's own registration agreement and the ICANN registrant rights and responsibilities also apply to your domain.

6. Website hosting

Your plan includes the number of websites and storage space shown when you order. Hosting is shared, which means your site shares a server with other customers' sites. To keep things fair and fast for everyone, you may not use your account for:

File sharing or download sites, game servers, or streaming video or music.
Storing backups or files that are not part of a website.
Anything that uses so much of the server that it slows down other customers.

If your site uses too much of the server, we will contact you first and help you find a fix, like a bigger plan. If it is harming other customers right now, we may limit it first and contact you right after.

7. Your website content and software

You are responsible for everything on your website, including its words, images, and information. We do not check, and are not responsible for, the accuracy of anything shown on a customer website.

You are also responsible for the software your website runs on, if it uses any. That includes blogs, WordPress, Joomla, Magento, their plugins and themes, and custom PHP scripts, whether you installed them or someone you hired did. It is your job to:

Keep that software updated, including security updates.
Keep it compatible with our server software as it is updated over time, such as new versions of PHP.
Fix or replace software that stops working, or that puts your site or our servers at risk.

We keep our servers updated and secure. We do not install, update, repair, or maintain software you supply.

8. Backups and your data

We save a copy of your hosting account every night and can use it to help restore your site. These copies are a safety net, not a guarantee. You are responsible for keeping your own copy of your website and data.

We do not look through your files except when you ask us to, to keep our servers safe, or when the law requires it.

9. Keeping your site online

Our servers run around the clock. Sometimes we need to do maintenance. When we plan maintenance that will interrupt your service, we give at least 48 hours notice by email whenever we can.

Our uptime promise: if your website is down for more than 8 hours total in a calendar month because of a problem with our servers, tell us within 30 days and we will add one free month to your account. You can receive up to 4 free months per calendar year. This does not cover problems caused by your own website or software, or events outside our control, like natural disasters, power grid failures, or failures of the internet outside our network.

10. Getting help

Support is by written request through our support form or your account area. A real person answers within one business day. We help with your hosting account, your domain, and moving your site. We cannot fix problems caused by changes, code, or add-ons made by you or someone you hired, but we will tell you what we find.

11. Rules for using our services

You are responsible for your website and everything on it, and for anyone you give access to your account. You may not use our services to:

Break any law, including copyright and trademark law.
Send spam or unwanted bulk email.
Spread viruses or harmful software, or host phishing or scam pages.
Break into or attack other computers, networks, or accounts, including ours.
Harass, threaten, or impersonate others.
Host sexual content involving minors, or promote violence or illegal goods.

If we believe in good faith that an account is breaking these rules, we may suspend it. If it is harming others or is illegal, we may do so right away, then contact you. Otherwise, we will contact you first and give you a chance to fix it. We cooperate with law enforcement, and we may share information about security attacks with the operators of affected networks.

Keep your password safe. Use a strong password you do not use anywhere else, and turn on two-step login in your account area if it is offered. Tell us right away if you think someone else has gotten into your account.

13. If we end your service

We may end your service if you seriously break these terms, as described above. We may also stop offering a service for any reason with at least 30 days notice by email. If we do that, we refund the unused part of anything you prepaid, except domains, which stay registered to you.

14. Warranties

WE PROVIDE OUR SERVICES "AS IS." EXCEPT FOR THE PROMISES WRITTEN IN THESE TERMS, WE DISCLAIM ALL OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT PROMISE THE SERVICES WILL BE ERROR FREE OR NEVER INTERRUPTED.

15. Limits on our liability

TO THE EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. WE ARE NOT LIABLE FOR LOST PROFITS, LOST DATA, OR INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES.

Some places do not allow these limits, so they may not all apply to you. Nothing in these terms limits liability that cannot be limited by law.

16. If someone makes a claim about your site

If someone makes a legal claim against us because of your website content or because you broke these terms, you agree to cover our reasonable costs of dealing with it, including reasonable attorney fees. We will tell you promptly about any such claim and let you take part in the defense.

17. Things outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, fire, flood, war, government action, power or internet outages, or failures of other companies' systems.

18. Changes to these terms

We may update these terms. If we make an important change, we will email you at least 30 days before it takes effect. If you do not agree with the change, you can cancel before then. Continuing to use the services after the change takes effect means you accept it.

19. Arizona law and disputes

These terms are governed by the laws of the State of Arizona. If you have a problem, please contact us first. Most issues are solved quickly by a real person.

If a dispute cannot be worked out, it will be handled in the state or federal courts located in Maricopa County, Arizona, and both of us agree to those courts. In a legal action about these terms, the winning side may recover its reasonable attorney fees, as Arizona law allows.

20. Other legal details

Notices. We send notices to the email address on your account. Send notices to us through our support form.
Transfer. You may not transfer this agreement to someone else without our written consent. We may transfer it to a company that takes over our business, and these terms will still protect you.
If part of these terms is invalid, the rest still applies.
Not enforcing a term right away does not mean we give up the right to enforce it later.
Entire agreement. These terms, our privacy policy, and our refund policy are the whole agreement between us about the services and replace any earlier versions.
